f:1240 -    Status of the Takbeer before Qunut in Witr Salaat

Question:     What is the Shariah ruling of raising hands before reciting Qunoot in Witr Salaat?  Is this Fardh, Wajib or Sunnah?  Please give proofs of this.

Answer:     It is Compulsory (Wajib) to say the Takbeer before reciting Dua Qunoot in the 3rd Raka’at of Witr Salaat.  Raising hands (up to the ears) is a Sunnah.  There is a Hadith in Musannaf Ibn Abi Shaiba:

Translation: Hadhrat ‘Abdullah bin Mas’ud (May Allah be well pleased with him), when he would finish the recitation of the Holy Quran (in Salaat Ul Witr), he would say the Takbeer (Allahu Akbar) and recite Qunoot.  It is clarified in another Hadith that at the time of Takbeer before Qunut, he would raise his hands till his ears.  (Musannaf Ibn Abi Shaiba, Vol. 2, Pg. No. 206)

‘Allama Ibn A’abideen Shami (May Allah shower His Mercy on him) has clarified that it is Compulsory (Wajib) to say the Takbeer before Qunut and raising hands when doing so is a Sunnah.  As is mentioned in Radd Ul Muhtaar, Kitaab Us Salaat, Waajibaat Us Salaat and in Baabul Witri Wan Nawaafil.
