f:912 -    Question about Wuquf Arafaat
Country : Hyd, India,
Name : Ali Naqshbandi Qadri
Question:     I had the honor and privilege of performing Haj this year.  We, the Hajis, remained at 'Arafat on the 9th of Dhil Hijjah.  Because of the multitude of people at 'Arafat, the management started seating the people in their vehicles just after 'Asr itself.  On the persistent insistence of the management, we had to leave the place where we had waited till 'Asr.  We loaded our luggage in the vehicle and kept praying by the side of our vehicle till we left.  Our vehicle left at around Maghrib and by the time we left 'Arafat, the sun had set.  I am in doubt about our stay at 'Arafat (Wuquf 'Arafat).  Did I have to perform any expiation (Kaffara) because we left early?
............................................................................
Answer:     Wuquf 'Arafat is the most important Fardh in Haj and is its primary article.  Even one remaining 1 moment in 'Arafat from after the twelve noon (Zawaal) of the 9th of Dhil Hijjah to the dawn (Subah Sadiq) of the 10th validates the Fardh; still, remaining in 'Arafat till the dusk of 9th is Wajib (compulsory).
It is given in Fatawa A'alamgiri, Vol 1, kitab ul manasik, al bal ul khamis fi kaifiyyati ad ail hajji, Pg no. 229:

Translation:  The time for Wuquf 'Arafat is from after the twelve noon of the day of 'Arafat to the dawn of 10th Dhil Hijjah and remaining in 'Arafat till the dusk of the 9th is Wajib.

There is no problem if, because of multitude of people, the Hajis leave 'Arafat before dusk and do not leave the boundaries of 'Arafat before dusk.

It is given in Fatawa A'alamgiri Vol 1, kitab ul manasik, al bal ul khamis fi kaifiyyati ad ail hajji, Pg no. 230:

Translation:  If the Haji is concerned about crowds, and because of this leaves from 'Arafat before dusk, there is no problem; provided he does not leave the boundaries of 'Arafat before dusk.  If the boundaries are crossed before dusk, then Dam is compulsory; as given in Bahr Ur Raqaaiq, Pg No. 596:

Translation:  Dam is Wajib if the boundaries of 'Arafat are crossed before dusk."

There is no problem if the vehicles do not leave 'Arafat before dusk, as you have mentioned in your question.  Therefore your Wuquf 'Arafat is valid and there is no Dam or expiation binding on you.

And Allah (Subhanahu Wa Ta’ala) knows best.
